Lawyer Andrew Egyapa Mercer, the Member of Parliament for Sekondi says government has the mandate to initiaite processes to dissolve a company limited by guarantee like the Ghana Football Association (GFA).
According to him, people must not misinterpret the intention of government to ‘trigger’ processes to dissolve the FA to amount to an instant dissolution. He said what the government put out means it has initiated processes to disband the GFA , in the wake of the Anas Aremeyaw Anas expose titled number 12.
Speaking to Samuel Kojo Brace on the Jolly Breakfast Show (JBS), this morning, in response to allegations by the minority that government does not have the rights to dissolve the GFA, the Sekondi Legislator stated that, the Body Cooperate (Official Liquidation) Act section 2 and 4 gives the government the power to dissolve any company limited by guarantee that engages in illegalities.
“When one reads the Body Cooperate Official Liquidation Act Section 2 and 4, it states clearly many ways private entities can be dissolved,” he noted.
He argued that Ghana upholds the rule of law and so the government cannot take decisions that are not in consonance with the law.
“We are in a country that believes in the rule of law so clearly government can’t do anything without resorting to the laws of the land,” he said.
